When appointing a third-country national to work on an employment contract, it is necessary to know the following:
If the worker is appointed to an employment contract with a basic salary of BGN 1,000, 8% health insurance is paid for Bulgarian citizens, amounting to BGN 80 per month, or BGN 960 for 12 months. For foreign citizens, these insurances are not paid because they do not have the right to health insurance in Bulgaria. Instead, a mandatory minimum annual health insurance (with emergency coverage of 30,000 EUR) is taken out for them, costing BGN 176. This means that with the first year of work, all expenses incurred for the relevant employee are covered by this difference.
In order to employ a third-country national (a non-EU citizen), the following conditions are necessary: the total number of third-country nationals with long-term residence permits working for the local employer in the previous 12 months must not exceed 20 percent of the average roster number of employed persons. For small and medium-sized enterprises within the meaning of Art. 3, para. 1, item 1 of the Law on Small and Medium Enterprises, this limit is 35 percent.
The approved job applicant must submit:
- Copy of valid international passport.
- Criminal record certificate with an apostille or with the necessary certifications to be valid before the state institutions of the Republic of Bulgaria.
- Diploma with an apostille or with the necessary certifications to be valid before the state institutions of the Republic of Bulgaria, or a notarized copy from the country of origin with an apostille or with the necessary certifications to be valid before the state institutions of the Republic of Bulgaria. For positions such as a general worker or hygienist, it is not necessary.
After the arrival of the necessary documents in the country, a file is prepared for each candidate worker separately and submitted to the Migration Service by the employer or a person authorized by them.
The application receives an opinion within 40-70 calendar days, after which the candidate worker is notified of the work permit and takes action to apply for a long-term visa D at the Bulgarian consulate corresponding to their place of residence. After obtaining a D visa (1-6 weeks, depending on the Bulgarian consulate) and arriving in the country, the worker will receive a residence and work permit within 3 weeks and start the employment contract.
